Driver Companion App (ARK Tracking): Our mobile application collects and processes location data from your device to enable driver tracking and efficient load assignment. This location data allows us to match drivers with nearby loads and provide real-time visibility to brokers and shippers. We may collect this data even when the app is running in the background if you have granted the necessary permissions, to ensuring accurate tracking during active shipments.
Web Application (ARK TMS): We may also collect location data from users of our web application (arktms.com), including location information derived from IP addresses. This data is used for security purposes, fraud prevention, and to enhance the overall user experience of our Service.
Log Data
We want to inform you that whenever you visit our Service, we collect information that your browser sends to us that is called Log Data. This Log Data may include information such as your computer’s Internet Protocol (“IP”) address, browser version, pages of our Service that you visit, the time and date of your visit, the time spent on those pages, and other statistics.
Cookies
Cookies are files with small amount of data that is commonly used an anonymous unique identifier. These are sent to your browser from the website that you visit and are stored on your computer’s hard drive.

SMS and Text Messaging Communications
ARK TMS LLC may send text messages (SMS) to users who have provided express written or verbal consent to receive such communications. This section describes our SMS practices and your rights regarding text messaging.

Users must explicitly opt-in verbally or by replying 'YES' to an initial consent request message before receiving any operational SMS messages. By replying 'YES', you provide express written consent under the Telephone Consumer Protection Act (TCPA) to receive automated and non-automated text messages from ARK TMS LLC.
Types of SMS Messages
If you opt-in, you may receive the following types of text messages:
- Account notifications and alerts
- Customer care and support communications
- Two-factor authentication (2FA) and one-time password (OTP) codes
- App-related instructions and download links
- Operational messages related to your account
Message Frequency and Costs
Message frequency varies but will not exceed 5 messages per month per user. Message and data rates may apply as determined by your wireless carrier. ARK TMS LLC does not charge for sending text messages, but your wireless carrier may charge standard message and data rates.
Opt-Out and Your Rights
You may opt out of receiving text messages at any time by replying STOP to any message. You may also opt out by replying STOPALL, UNSUBSCRIBE, CANCEL, END, or QUIT. After opting out, you will receive one final confirmation message. For help, reply HELP to any message.
Your consent to receive text messages is not a condition of purchase or use of any ARK TMS services. Opting out will not affect your ability to use other features of our Service, though you may need to use alternative authentication methods if you opt out of OTP/2FA messages.
SMS Data Collection
When you opt-in to SMS communications, we collect and store the following information:
- Your phone number (for message delivery)
- Consent timestamp (when you replied 'YES')
- Opt-out status and timestamp (if you reply 'STOP')
- SMS delivery status (for troubleshooting and compliance)
- Message content (stored for record-keeping and compliance purposes)
This information is used solely for delivering SMS messages, maintaining compliance records, and providing customer support. We do not sell, rent, or share phone numbers or SMS data with third parties for marketing purposes. Phone numbers are only shared with:
- Your freight broker or carrier (the company that invited you to use ARK TMS)
- Twilio, our SMS service provider (for message delivery only)
- As required by law or legal process

Service Providers
We may employ third-party companies and individuals due to the following reasons:
- To facilitate our Service;
- To provide the Service on our behalf;
- To perform Service-related services; or
- To assist us in analyzing how our Service is used.
We want to inform our Service users that these third parties have access to your Personal Information. The reason is to perform the tasks assigned to them on our behalf. However, they are obligated not to disclose or use the information for any other purpose.
Third-Party SMS Provider:We use Twilio, Inc. as our SMS service provider to deliver text messages. Twilio has access to your phone number and message content solely for the purpose of delivering messages on our behalf. We value your trust in providing us your Personal Information, thus we are striving to use commercially acceptable means of protecting it. But remember that no method of transmission over the internet, or method of electronic storage is 100% secure and reliable, and we cannot guarantee its absolute security.

Our Services do not address anyone under the age of 13. We do not knowingly collect personal identifiable information from children under 13. In the case we discover that a child under 13 has provided us with personal information, we immediately delete this from our servers. If you are a parent or guardian and you are aware that your child has provided us with personal information, please contact us so that we will be able to do necessary actions.
